Possession of an Offensive Weapon

 

  • Possession of an Offensive Weapon

An Offensive weapon is “any article made or adapted for use for causing injury to the person or intended by the person having it with him for such use by him or by some other person”. 

 

  • Possession of an article with blade or point in a public place

Applies generally to any article which has a blade or sharp point

  • Possession of a corrosive substance 

This relates to a substance which is capable of burning human skin by corrosion.

 

In the instances stated above, the points for the prosecution prove are as follows:

  1. The accused had with them 

  2. In a Public place

  3. The accused was not Lawfully carrying the offensive weapon nor did they have the required authority or reasonable excuse” 

  • Possession in Schools - Possession of an article with blade or point or offensive weapon on education premises is unlawful unless there is permissible defence.
